Overview: Title IX and Transgender Students

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance..." Title IX of the Education Amendments of 1972, 20 U.S.C. § 1681.

The application of Title IX with transgender individuals has become a topic of lively debate recently. Under the Obama Administration, there were protections that allowed Title IX to be easily applied to transgender students. Analysis and guidance of the regulations under the Obama and Trump administrations, along with coverage of the issue within the judicial system, will be presented in this research guide. Examining Title IX in the context of case law along with both presidential administrations provides a robust look at the current climate when applied to transgender students.
