Where children were adjudged neglected due to refusal of their parents to have them immunized against poliomyelitis and because of such failure they were unable to attend school, Family Court would enter order in accordance with FCA §§ 352(a), 353 ordering judgment against parents be suspended for period of 30 days during which time parents would be given opportunity to take proper steps to assure school attendance of their children by having them immunized, in which event no further neglect under these statutes would exist.

N.Y. Pub. Health Law §2164: Statutory Exemptions

N.Y. Pub. Health Law § 2164 permits the following two exemptions to this mandatory immunization requirement:
(1) If the parent objects to the immunization because the parent holds genuine and sincere religious beliefs which are contrary to the requirement that the child be immunized; or

(2) If a New York State licensed physician certifies that such immunization may be detrimental to the child’s health.
