W. Tradition P'ship v. Bullock, 291 P.3d 545 (2012)Montana Supreme Court decision that challenged Citizens United, finding that "Citizens United does not compel a conclusion that Montana’s law prohibiting independent political expenditures by a corporation related to a candidate is unconstitutional. Rather, applying the principles enunciated in Citizens United, it is clear that Montana has a compelling interest to impose the challenged rationally-tailored statutory restrictions."
The U.S. Supreme Court granted a
stay pending petition for cert on Feb. 17, 2012. In granting the stay, Justice Ginsberg said "[a] petition for certiorari will give the Court an opportunity to consider whether, in light of the huge sums currently deployed to buy candidates’ allegiance, Citizens United should continue to hold sway." Reversed sub nom. Am. Tradition P'ship v. Bullock, 132 S.Ct. 2490 (2012).
