The State of Environmental Crime Enforcement: A Survey of Developments in 2011This article, an annual review of environmental crime enforcement, looks at lessons that may be learned from the investigation and prosecution of the Deepwater Horizon oil rig explosion and spill, including the criminal provisions of environmental law that could be brought to bear, corporate actions prior to the incident that will draw scrutiny, and issues related to possible obstruction of justice after the incident.
As in past reviews, the authors also provide summaries of criminal cases brought around the country in 2011. In addition, the article features an interview with Ignacia S. Moreno, Assistant Attorney General in charge of the Justice Department's Environment and Natural Resources Division, and Peter Smith, the U.S. Attorney for the Middle District of Pennsylvania, on the subject of hydraulic fracturing in oil and gas operations.
