Comparative Criminal Procedure: Primary Sources

Guide to print and online resources for comparative criminal procedure research.

Primary Sources - Introduction

Increasingly, countries are making statues and cases available to the public via the Internet. There are several strategies for finding relevant primary materials in translation:

  • Start with a legal research guide about that country for an overview of the organization of law in that country, links to online sources of foreign domestic law, and citations to print sources of foreign domestic law for that country.
  • Go directly to the government website(s) for that country and search for relevant materials.
  • Use online sources of cases, statutes and regulations such as countries included in WorldLII.
  • Follow up on references to statutes, cases and regulations that you will find in secondary sources which discuss the laws of a particular country.

Foreign Domestic Law - Research Guides

Legal Research Guides should provide an overview of the organization of law in that country, links to online sources of foreign domestic law, and citations to print sources of foreign domestic law for that country.

Foreign Domestic Law - Online Sources

Lexis.com and WestlawNext have limited availablity of foreign domestic legal materials.  Some government and non-profit organizations are making foreign domestic law freely available online.  The best approach is often to use a combination of resources. For example, if you were researching Australian law, you could search Australian cases on Lexis.com or WestlawNext, but you would have to use another source, such as AustLII (The Australasian Legal Institute) to find relevant statutes.
